Specifics about the new charges and how the others would be changed were not immediately available in the case's court register.
In the motion, prosecutors also asked to amend 17 charges, including 16 attempted murder charges. Judge William Sylvester of the 18th Judicial District must approve the changes, according to the Post.
As it stands, Holmes, 24, faces 142 charges – 24 counts of first-degree murder and 116 counts of attempted murder. He is accused of shooting up a packed movie theater in Aurora, Colo., on July 20. Twelve people were killed and 58 were injured.
Holmes, a former graduate student in neuroscience, allegedly arrived at the midnight showing of the latest Batman movie armed with weapons and explosives.
